The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

By using the Services, you confirm that you have the legal capacity to enter into a binding agreement under applicable law. If you are under 18 years of age, you may use the Services only with the involvement and consent of a parent or legal guardian. 
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We aim to describe and display our products and services as accurately as possible. However, colours and product appearance may vary slightly depending on your device, screen settings, lighting, and production batches.

Nothing in these Terms limits your statutory rights if a product does not conform to the contract, is defective, or does not match the description provided.

Product descriptions, availability, and specifications may be updated from time to time before an order is accepted. We reserve the right to discontinue products or limit quantities offered, where reasonably necessary, including because of availability, production capacity, delivery restrictions, or suspected unauthorised resale. These changes will not affect orders that we have already accepted, except where permitted by applicable law.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Sleeplandia may refuse or cancel an order only for legitimate reasons, including product unavailability, an obvious pricing or product-description error, suspected fraud or unauthorised transactions, delivery restrictions, or where we cannot reasonably fulfil the order. Where we cancel an order after payment has been taken, we will refund the amount paid without undue delay. Your order is not accepted until Sleeplandia confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Sleeplandia may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. 
Your statutory rights, including the right of withdrawal for eligible distance purchases and your rights in relation to products that are defective or do not conform to the contract, are not limited by these Terms. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless stated otherwise, prices displayed to consumers include applicable VAT. Delivery charges and any other mandatory costs will be shown clearly before you place your order. If you order for delivery outside the European Union, import duties, taxes, and customs charges may apply and are your responsibility unless we state otherwise at checkout. 
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete, and accurate order, billing, payment, and contact information for purchases made through the Services. You confirm that you are authorised to use the payment method selected for your purchase and that the payment information you provide is accurate. We may use third-party payment service providers to process payments.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 5 - SHIPPING AND DELIVERY

We deliver to the destinations shown at checkout or listed in our Shipping Policy [LINK]. Delivery times shown on the Services or in order communications are estimates, unless we have expressly agreed a specific delivery date.

We will deliver your order within the period stated at checkout or otherwise within the period required by applicable law. If delivery is delayed, we will inform you where reasonably possible. Nothing in these Terms limits your statutory rights where we fail to deliver within an agreed or legally required period.

The risk of loss of or damage to products passes to you when you, or a third party nominated by you other than the carrier, acquire physical possession of the products.

If you provide an incorrect delivery address, fail to collect a parcel after reasonable notice, or refuse delivery without a valid reason, additional delivery or return costs may be charged only where permitted by applicable law and where we have informed you in advance.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Sleeplandia, its affiliates or licensors and are protected by Dutch, European Union, and other applicable intellectual-property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Sleeplandia, Shopify or any third party. Unauthorised use of the Services may violate applicable intellectual-property laws. All rights not expressly granted herein are reserved by Sleeplandia. 
Sleeplandia's names, logos, product and service names, designs, and slogans are trademarks of Sleeplandia or its affiliates or licensors. You must not use such trademarks without the prior written permission of Sleeplandia. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Sleeplandia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Sleeplandia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sleeplandia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sleeplandia.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here [LINK], and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

We may cancel an order only where there is an obvious and genuine error, such as a clear pricing, product-description, or availability error, or where cancellation is otherwise permitted by applicable law. If we cancel an order after payment has been taken, we will refund the amount paid without undue delay.

Nothing in this section limits your statutory rights where information provided by us was incorrect or misleading.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 15 - PRODUCT INFORMATION AND STATUTORY RIGHTS
We aim to ensure that information on the Services is accurate and up to date. However, product images, descriptions, availability, and other content may contain occasional errors or may change over time.

Nothing in these Terms excludes, restricts, or limits any statutory rights you have as a consumer, including your rights where products are defective, do not conform to the contract, or do not match their description.

To the extent permitted by applicable law, we exclude warranties and conditions that are not mandatory by law. This does not affect rights that cannot lawfully be excluded or limited.


SECTION 16 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where this would be unlawful, including liability for fraud, intentional misconduct, gross negligence where liability cannot lawfully be excluded, death or personal injury caused by our negligence, or any liability that cannot be excluded or limited under mandatory consumer-protection law.

Subject to the preceding paragraph, Sleeplandia is liable only for direct loss that is a foreseeable consequence of our breach of these Terms or applicable law. We are not liable for indirect or consequential loss, including loss of profit, loss of business, or loss of data, to the extent permitted by applicable law.

Nothing in this section affects your statutory rights as a consumer, including your rights in relation to defective or non-conforming products.


SECTION 17 - UNLAWFUL OR MALICIOUS USE OF THE SERVICES 

You must not introduce viruses, malware, ransomware, malicious code, or any other technologically harmful material to the Services. You must not attempt to gain unauthorised access to the Services, the server on which the Services are hosted, connected databases, or any other systems connected to the Services.

If you intentionally or unlawfully breach these Terms or applicable law and this directly causes Sleeplandia loss or damage, you are responsible for that direct loss or damage to the extent permitted by applicable law.

Nothing in this section limits any rights or remedies available to Sleeplandia under applicable law, including the right to suspend access, preserve relevant evidence, seek injunctive relief, report suspected criminal conduct to the police or other competent authorities, and pursue compensation where legally available.

SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms in connection with a merger, sale of business, restructuring, or transfer of assets, provided that this does not reduce the protections or rights you have under these Terms or applicable law. Where required by applicable law, we will notify you of such transfer.

These Terms and any purchase agreement between you and Sleeplandia are governed by Dutch law.

If you are a consumer habitually resident in another European Economic Area country, this choice of Dutch law does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence.

Any dispute may be submitted to the competent court under applicable law. Nothing in these Terms restricts a consumer’s right to bring a claim before a court that has jurisdiction under mandatory consumer-protection rules.
